General terms and conditions for Postaphoto Ireland Ltd, trading as Twelve (TwelvePhotos.com)

Introduction

1.1. These are the general terms and conditions of Twelve, trade name of Postaphoto Ireland Ltd hereinafter collectively referred to as "Twelve", "we", or "us". These general terms and conditions are referred to as "T&C's".

1.2. Twelve is registered in Ireland to Ashford House, Ballindud, Co. Waterford. We are registered with the Companies Registration Office, number 769950. Our VAT number is IE4323751MH.

1.3. The word "customer" or "you" is defined in these T&C's as the person who uses our websites, our apps, registers and uses an account, uses our photo editor and other services, purchases our products, requests for information or shows an interest in our products.

1.4. You may reach us through our customer care department. You may contact us through our website, email us directly to hello@twelvephotos.com or contact us via one of our official social media accounts. All our contact information is easily accessible on our website www.twelvephotos.com

Applicability

2.1. These T&C's apply to the use of our websites, our apps, to the registration and use of an account, to the use of our photo editor and other services available from time to time, to all our offers, to the orders you place and to the agreements and other legal relationships entered into between us and you. These T&C's also apply to subsequent and additional offers, orders and agreements, and to new agreements with you.

2.2. When registering for an account on one of our websites or our apps, you will be asked to accept the T&C's. When placing an order, you will also be asked to accept the T&C's. In both cases the T&C's are available to you for review where you will also find an option to print them for later examination.

2.3. These T&C's are easily accessible electronically on all of our websites and our apps. Upon request they will be sent to you without delay and at no cost.

2.4. You must ensure that the email address we hold for you is kept up-to-date and that you have full access to it – we will be sending you important messages there. So if you change your email address, you must change it on your account too. You should also ensure that emails from us are not routed to a spam folder in your email account. Should you provide an invalid email address or an email address that belongs to someone else, we may terminate your account at any time without notice.

Formation of the agreement

3.1. Offers are made without obligation.

3.2. By proceeding with your initial order for your set of free photo prints, whether the order is ultimately placed or not, you are agreeing to be added to our marketing list and agree to be contacted by us in future for further promotional, marketing, research, or other relevant purposes. You can unsubscribe or withdraw your consent at any time. Please email hello@twelvephotos.com if you wish to have your personal information removed from our database.

3.3. Our offers are presented to you in our online order process, or in other ways identified by us as such, on the basis of your specific request. General offers on our websites, our apps, in our emails and in promotional materials are for information purposes only and are not considered as offers. We shall confirm receipt of your order to you by e-mail in a timely manner.

3.4. You may accept our offer by proceeding with your order for either free or paid prints and/or confirming or making payment in the order process. Upon receipt of your order, your order is placed and the agreement is formed, on the condition precedent that the upload of your photos was successful. All orders are subject to our T&C's.

3.5. We shall confirm receipt of your order to you by email in a timely manner.

3.6. Please note that we reserve the right not to fulfill an order in certain circumstances, including without limitation where (i) an order breaches the requirements of these T&C’s (ii) images are corrupted, unsupported technically or inadequately pixelated (iii) the product you order being unavailable (iv) we are unable to obtain authorisation for your payment (v) a pricing or product description error being identified. If we reject your order, we will contact you to confirm this and reverse the payment you have made for that order.

Performance of the agreement and delivery

4.1. We will immediately start the performance of the agreement upon its formation by processing your order.

4.2. It is our intention to start the production of your order on the workday following the day the agreement was formed. Our websites and our apps contain information on estimated delivery times for our products and these may differ depending on the time of the year, as seasonal circumstances may affect the time required to process orders in our production facilities. Delivery terms will be in line with our obligations and as disclosed to you.

4.3. In case you order more than one product at once, we may ship them together in one package. In that case the longest delivery time applies.

4.4. If not collected by you, orders may be delivered by An Post or another carrier. We currently only deliver to addresses within the Republic of Ireland.

Prices and payment

5.1. Prices, in our emails and in promotional materials may differ from time to time, according to availability, customization choices and promotional timelines.

5.2. Prices are including VAT where applicable and all applicable taxes and inclusive of shipping costs within Ireland. Prices do not include international shipping charges, nor any applicable import duties or levies. International delivery is not currently available.

5.3. The price of your particular order and the shipping costs are shown in the order process as part of our offer, which you accept by making payment, the final step in our order process. All orders include free delivery via An Post.

5.4. Payment Options:

  • Pay As You Go: Pay €6.95 per envelope of 12 prints at the time of order. Price includes delivery.

  • Subscription: Choose to print up to 1, 3 or 5 envelopes per month.

    • 1 envelope/month: €6.95/month

    • 3 envelopes/month: €18.95/month

    • 5 envelopes/month: €29.95/month
      Subscriptions include free delivery and allow users to carry unused credits forward. Users can upgrade, downgrade, or cancel their subscription anytime directly within the app. Partial month refunds are not offered. Users retain unused credits if they cancel, but lose all credits if they delete their account.

  • Bundles: One-time purchase of envelopes to use any time. Ideal for gifting.

    • 3 envelopes: €19.95

    • 6 envelopes: €39.95

    • 9 envelopes: €59.95

    • 12 envelopes: €79.95
      Bundles never expire and include free delivery. Bundles are non-refundable.

5.5. If payment for a subscription fails, credits for that month will not be applied. Users will be notified and may update their payment method in the app to resume their plan.

5.6. The first envelope of prints is available for free for all users. This offer can be accessed in the app at checkout on your first order. By availing of this offer, you agree to our marketing terms as laid out in these terms.

5.7. Our websites and our apps contain information about the various payment methods that are available to our customers. All payments are processed securely via Stripe, Revolut Pay, Apple Pay or Google Pay. Refunds may be subject to the processing policies of the selected payment provider.

5.8. We do not offer refunds on prints unless your statutory consumer rights are affected. Refunds are not issued for change of mind due to the personalised nature of our products. Damaged envelopes cannot be refunded, but we will resend any envelopes that are undelivered. Refund or reprint requests must be submitted within 28 days of placing your order. Refunds are processed within 5–10 working days; reprints are processed within 2–5 working days.

5.9. You place your order by making payment in our order process. Upon receipt of the payment, the agreement is formed on the condition precedent that the upload of your photos was successful. Once we've received your payment, we send you a confirmation by email.

Wedding Bookings – Availability

6.1. Twelve Weddings is a specialised service offering available for weddings taking place from 1st June 2026 onwards.

6.2. By booking a Twelve Weddings package, you confirm that your wedding date falls on or after 1st June 2026.

6.3. Any bookings made for wedding dates prior to 1st June 2026 may be declined or cancelled at our discretion, and any payments made will be refunded in full.

6.4. We reserve the right to amend availability dates for Twelve Weddings in the future. Any such changes will be clearly communicated on our website and will not affect bookings already confirmed.

Data Protection and Privacy

7.1. We are committed to protecting your personal information and your right to privacy. All customer data is processed in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).
7.2. When you use our website or app, we collect only the personal data necessary to process your orders, provide support, or send communications related to your purchases, promotions, and service updates.
7.3. Photos uploaded to Twelve are encrypted in transit and at rest, and stored securely on Google Cloud servers located in the European Union.
7.4. Users may delete individual photos at any time. Deleted photos are subject to a 30-day soft delete period, during which they are inaccessible but recoverable. After 30 days, they are permanently purged from our systems.
7.5. We do not use, sell, or share your photos or personal data with any third parties, except where necessary to process orders (e.g. Stripe, Apple Pay, or Google Pay for payment processing), or where required by law.
7.6. We will only ever use customer photos for promotional or marketing purposes with your explicit, informed consent. This consent will be actively sought and is never assumed.

Account and Data Deletion

8.1. You may request to delete your account and all associated data at any time via the profile settings in the app.
8.2. Upon initiating deletion, your account and photo history will be subject to a 30-day soft delete period, after which all data will be permanently deleted unless otherwise required to comply with legal or operational obligations.
8.3. Account deletion is permanent and cannot be undone. Unused credits will be lost if you delete your account.

Use of Free Prints and Marketing Communications

9.1. If you avail of a free set of prints through the app, you agree to be added to our marketing communications list.
9.2. We will use your email and in-app messaging to share product updates, offers, promotions and other relevant news about Twelve.
9.3. We will never share your information with third parties for their own marketing purposes, and we will never spam you.
9.4. You can unsubscribe at any time by clicking ‘unsubscribe’ in our emails or by contacting us directly at hello@twelvephotos.com.

Copyright and Image Rights

10.1. You are responsible for ensuring that any photos you upload do not infringe on any copyright, trademark, or personal rights of others.
10.2. By uploading images to Twelve, you confirm that you have the right to use and reproduce those images for personal use.
10.3. We reserve the right to refuse to print content that is unlawful, offensive, or violates the rights of others.

App Permissions

11.1. Our app may request access to your device’s camera, photo library, and location services for the purpose of enabling features and improving your user experience.
11.2. You may disable permissions at any time through your device settings, though doing so may affect app functionality.

Cookies and Tracking Technologies

12.1. Our website and app may use cookies or similar technologies to enhance user experience, analyse usage, and support marketing efforts.
12.2. You can manage your cookie preferences through your browser or device settings.

Limitations of Liability

13.1. While we take great care in printing and delivering your order, we are not liable for indirect or consequential losses.
13.2. Our total liability in connection with any order is limited to the amount paid for that specific order.

Service Availability

14.1. We aim to ensure uninterrupted access to our services, but we may occasionally need to carry out maintenance or improvements.
14.2. We cannot guarantee that the app or website will always be available, error-free or compatible with all devices or software.

Complaints and Customer Support

15.1. If you have a complaint or concern, please contact us at hello@twelvephotos.com. We aim to resolve all issues quickly and fairly.
15.2. Complaints related to orders (including requests for reprints or refunds) must be submitted within 28 days of placing the order.

Governing Law and Jurisdiction

16.1. These Terms and Conditions are governed by the laws of Ireland.
16.2. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.

Updates to Terms and Conditions

17.1. We reserve the right to update these Terms and Conditions from time to time.
17.2. Any changes will be communicated on our website or via email, and your continued use of our services constitutes acceptance of the revised terms.
